Breizh VOIP app for Android and iOS

Purpose

These terms govern the use of the Breizh VOIP mobile app, on any device it is installed on. They come in addition to the general terms of the telephony service subscribed by your company, and do not replace them. Installing the app or signing in constitutes acceptance of these terms.

What the app does

The app extends your company's phone system to your mobile. It lets you make and take calls on your work line, switch to video, exchange messages with colleagues, listen to your voicemail and see who is available. It is not a standalone telephony service: it works only with a line opened under a subscription held by a company, and stops working when that line is closed.

Your account

Accounts are not created from the app: your company opens, administers and closes them, and decides what rights yours carries. Your credentials are personal: you must not share them, nor let anyone use the app in your name. Report any use you did not authorise to your administrator without delay.

Acceptable use

The app is a professional tool. In using it, you undertake to:

  • comply with the law, in particular the rules on recording conversations: warning the other party before recording is your responsibility as much as ours;
  • not use it for unsolicited canvassing, harassment or any harmful purpose;
  • not attempt to bypass its protections, decompile it or extract how it works;
  • not deliberately overload the service or disrupt it for others;
  • respect the confidentiality of the exchanges your role gives you access to.

Emergency calls: a limit to know about

This is the most important point in these terms. IP telephony depends on an internet connection and on your device's battery: if either fails, no call goes out, including to an emergency number. What is more, the location passed to the emergency services is the one attached to your line, which may differ from where you actually are. Always keep another way of calling for help, in particular an ordinary mobile phone.

Permissions requested on your device

The app requests the permissions its operation requires, and nothing more. Each one, and what it is used for, is detailed in the app's privacy policy. In short:

  • the microphone and camera, for your calls and video meetings;
  • notifications, to alert you to an incoming call even when the app is closed;
  • contacts, read only, to dial a number from your address book;
  • Bluetooth and audio settings, to use a headset or hands-free kit;
  • wake lock and foreground service, so the phone rings and the call holds.

Service availability

We put in place the means required for continuity of service, without that amounting to an obligation of result in the absence of a separately subscribed service level agreement. Interruptions may occur for maintenance, announced where possible, or through outside events: an access network failure, a third-party carrier outage, or your operating system's notification service being unavailable.

Personal data

The app is used with an account created by your company, which remains the data controller under the GDPR; we act as processor. The data processed, how long it is kept and your rights are set out in the app's privacy policy, available from the app listing and from our site.

Closing your account

Your account belongs to your company: its administrator is the one who closes it, and closure is immediate once they ask. If you cannot reach your administrator, write to [email protected]: we pass the request to the company responsible and tell you what came of it. Uninstalling the app does not close the account: it only clears the data held on the device.

Intellectual property

The app, its interface, its components and its documentation remain the property of BREIZH VOIP. You receive a personal, non-exclusive and non-transferable right of use, limited to the duration of your access to the service and to the needs of your professional activity. That right does not include copying, modifying or distributing the app.

Updates

The app evolves. Some updates fix defects or security flaws: we may make installing them necessary in order to keep using the service, and a version that is too old may stop working. Updates are distributed through your device's app store.

End of access

Your access ends when your company closes your account, when it ends its subscription, or when your use of the app seriously breaches these terms. In that last case, we inform the company responsible for the account.

Liability

We may only be held liable where fault is proven, and our liability is limited to direct damages. It does not cover indirect losses, in particular loss of operations, revenue or data. Nothing in these terms limits our liability in the event of personal injury or of gross or wilful misconduct.

Changes to these terms

These terms may change, in particular to follow a change in the app or in the applicable rules. The version in force is the one published on this page, whose update date appears at the bottom. Any substantial change is brought to the attention of the company holding the subscription.

Governing law

These terms are governed by French law. In case of difficulty, write first to [email protected]: you will receive a written answer. This step is required before any other proceedings.
